Based on industry standards and practices, here are the proposed Terms and Conditions for www.kate-illustrate.co.uk:

Definitions:

Client: as identified by invoice, or order processed through the website.

Artist: Kate Illustrate

Project: Bespoke Illustration, Workshops, Murals or Personalised Stationery Orders

Product: Calligraphy Supplies, Subscription Service, Workshops etc.

1. Introduction

These Terms and Conditions govern the use of the website www.kate-illustrate.co.uk ("Website") and the services provided by Kate Illustrate ("Artist", "we", "us", or "our"). By accessing or using our Website and services, you ("Client", "you", or "your") agree to comply with and be bound by these Terms and Conditions.

2. Services

Kate Illustrate offers various services, including but not limited to:

  • Calligraphy workshops

  • Subscription boxes

  • Calligraphy Products

  • Gifts

  • Custom illustrations

  • Hand-painted products

3. Ordering and Payment

Upon ordering products from the website, the items will be shipped within 3-7 business days unless otherwise stated on the top of the website.. Orders can only be cancelled if we have not yet processed your order for shipping. Once the items are shipped, we cannot cancel your order. Once the items leave the studio, the artist is not liable for lost, delayed, or damaged shipments. The estimated delivery times provided in the shipping options are NOT a guarantee. We are not liable and will not provide refunds for shipping and/or on delayed shipments. If you require items by a certain date, please reach out to us at kate@kateillustrate.co.uk for other shipping options. 

Unused and unopened orders may be returned upon approval within 14 days of receipt for a refund. Please email kate@kateillustrate.co.uk with a photograph of your item along with your name and order number. The shipping costs must be paid by the client if you are returning a product. Once the returned item(s) have arrived safely to the studio, the charges will be credited to your original method of payment excluding shipping costs, which are non-refundable, and a 20% restocking fee. Used, opened, and/or final sale or items with coupon codes cannot be returned. 

  • Placing an Order: To commission a custom illustration or purchase a product, please contact us through the contact information provided on our Website.

  • Pricing: Prices for services and products are listed on the Website and are subject to change without notice.

  • Payment Terms: For services priced at £300 or below, full payment is required upfront before work commences. For services priced above £300, a discussed deposit is required to initiate the project, with the remaining due upon completion and prior to delivery/ completion of the final work.

4. Cancellation and Refunds

  • We are not liable and will not provide refunds for shipping and/or on delayed shipments. If you require items by a certain date, please reach out to us at kate@kateillustrate.co.uk for other shipping options.

  • Refunds: Refunds are not provided for completed work that meets the agreed-upon brief and specifications.

  • Digital downloadable products are non-refundable, non-returnable and ineligible for exchange.

  • Bespoke Items are non-refundable, non-returnable and ineligible for exchange.

  • For orders with ink jars, there is possibility of leakage due to pressure changes in shipping. We seal our bottles and package them with bubble wrap bag to avoid spillage across other materials. We will provide replacement free of charge if the bottle has caused damage to the product. You may need to return the product. Please email kate@kateillustrate.co.uk with a photograph of your item along with your name and order number.

  • To maintain product quality, we check every product when leaving the studio however, we understand that at times there may be instances where the items may be broken or performing in less than ideal condition. Please email kate@kateillustrate.co.uk with a photograph of your item along with your name and order number so that we can assess this further.

  • Sale products are not eligible for refund, return or exchange.

5. Delivery

  • We will use our best efforts to deliver the commissioned work or products by the agreed-upon date. However, we are not liable for any delays caused by unforeseen circumstances. Please contact kate@kateillustrate.co.uk for International delivery options. Due to the worldwide shipping delays, there may be some delay for your items to get to you.

    Subscription - The Calligraphy Boxes are shipped following payment. They will be posted at the end of the month so that they aim to arrive at the beginning of the following month. The client will be notified by email when your box has been posted.
    UK delivery is ‘free’ and will be sent via Royal Mail 2nd Class Signed For, 2-3 days (excluding Sunday). Please contact kate@kateillustrate.co.uk for International delivery options.

6. Intellectual Property Rights

  • Original art remains the property of the Artist.

    The client agrees to indemnify and hold the Artist harmless against any and all claims, costs, and expenses, including attorney’s fees, due to materials included in the work at the request of the client for which no copyright permission or privacy release was requested, or for which uses exceed the uses allowed pursuant to a permission or release.

    The artist retains the right to reproduce, publish and display the project in the Artist’s portfolios and websites, in galleries, design periodicals, social media and any other media or exhibits, now known or devised in the future, for the purposes of recognition of creative excellence or professional advancement, and to be credited with authorship.

    Kate Illustrate owns the copyright for the designs of the products on this website. 

  • License: Upon full payment, the Client is granted a license to reproduce the artwork solely for the purposes agreed upon. Any additional use requires a separate license and may be subject to additional fees.

7. Modifications and Revisions

If the Client requests changes that deviate from the original brief, additional fees may apply. The Artist reserves the right to refuse substantial changes that alter the nature of the commission.

Subscription Boxes - Pause/ Cancelation
You can pause your subscription for up to 2 months at anytime. You can do this by messaging kate@kateillustrate.co.uk 
If you would like to cancel your subscription then we are sad to see you go, but you are able to do this by contacting kate@kateillustrate.co.uk 

8. Limitation of Liability

The Artist is not liable for any indirect, incidental, or consequential damages arising from the use of our services or products.

9. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.
